Spanish Law 12/1986 of 1 April recognises the full professional powers and responsibilities of technical engineers within their respective fields of specialisation and expressly includes the preparation of expert assessments, studies and reports .
In the field of information technology, the Resolution of 31 March 2026 of the General Secretariat for Universities expressly includes, among the competences associated with official university qualifications leading to the profession of Technical Engineer in Information Technology, the knowledge required to carry out measurements, calculations, valuations, appraisals, expert assessments, studies and information technology reports .
Entrusting a digital forensic examination to a person who cannot provide evidence of an official university degree in Computer Engineering may seriously compromise the defence of the case. The opposing party may challenge the expert’s qualifications, the methodology applied and the technical reliability of the conclusions, weakening the evidential value of the expert report and placing at risk digital evidence that may prove decisive in the proceedings.
Given the risk of unqualified professional practice in this field, before commissioning a digital forensic examination, make sure that the professional holds an official university degree in Computer Engineering , has proven experience, is professionally registered and possesses specific knowledge of the subject matter under examination.
Qualifications, experience, registration with officially recognised professional bodies, rather than mere membership of private associations , the methodology applied, the proper preservation of the chain of custody and respect for fundamental rights are essential elements in providing the court with an expert report that is technically rigorous, reliable and defensible before the court .
