Digital forensic analysis of software defects

Nowadays, a large part of the activity carried out by companies and professionals depends on software applications, web platforms, management systems and software developed or configured for specific purposes. When their operation becomes the subject of dispute in legal proceedings, a forensic IT examination can assess whether the system performs the expected functions, whether it meets the applicable requirements and whether the reported incidents actually correspond to software defects.

An isolated incident, a screenshot or a support ticket is not, by itself, sufficient to conclude that a software application is not functioning correctly. In the field of information technology, the Resolution of 31 March 2026 of the General Secretariat for Universities expressly includes, among the competences associated with official university qualifications leading to the profession of Technical Engineer in Information Technology, the knowledge required to carry out measurements, calculations, valuations, appraisals, expert assessments, studies and information technology reports .
Entrusting a digital forensic examination to a person who cannot provide evidence of an official university degree in Computer Engineering may seriously compromise the defence of the case. The opposing party may challenge the expert’s qualifications, the methodology applied and the technical reliability of the conclusions, weakening the evidential value of the expert report and placing at risk digital evidence that may prove decisive in the proceedings.
