Digital forensic analysis of photographic evidence

Today, technology is present in almost every aspect of our lives and, as a result, digital evidence is playing an increasingly important role in legal proceedings. One of the most common examples is the submission of digital photographs as a means of supporting or refuting facts, which may require an assessment of their origin, authenticity and integrity.

However, it is still common for a printed image to be submitted as the sole piece of evidence, without the technical elements required to verify its reliability. Such evidence may be challenged because, due to their digital nature, images may have been manipulated without a simple printout allowing their origin, authenticity and integrity to be properly verified.

What do we analyse in a digital image forensic examination?

  • Preservation and chain of custody: acquisition and preservation of the digital image using procedures that make it possible to demonstrate its integrity and document the actions carried out throughout the examination.
  • Origin, authenticity and integrity of the image: examination of the file and the device concerned to assess where the image came from, whether it was captured directly by that device or added at a later stage, and whether it shows any signs of manipulation.
  • Metadata and technical structure analysis: examination of dates, capture device, camera characteristics, software used, file format, resolution, compression and any other information available within the file.
  • Temporal and geographical analysis: assessment of the date, time and location associated with the image, provided that sufficient data is available to examine, compare and assess their consistency.
  • Comparative analysis of historical and current images: examination of images obtained on different dates to assess the appearance, absence, development or transformation of buildings, structures and other visible elements.
  • Independent expert review of digital images: technical review of the images and expert reports submitted by the opposing party to determine whether their conclusions are supported by the files examined and the methodology applied.

Spanish Law 12/1986 of 1 April recognises the full professional powers and responsibilities of technical engineers within their respective fields of specialisation and expressly includes the preparation of expert assessments, studies and reports .
In the field of information technology, the Resolution of 31 March 2026 of the General Secretariat for Universities expressly includes, among the competences associated with official university qualifications leading to the profession of Technical Engineer in Information Technology, the knowledge required to carry out measurements, calculations, valuations, appraisals, expert assessments, studies and information technology reports .
Entrusting a digital forensic examination to a person who cannot provide evidence of an official university degree in Computer Engineering may seriously compromise the defence of the case. The opposing party may challenge the expert’s qualifications, the methodology applied and the technical reliability of the conclusions, weakening the evidential value of the expert report and placing at risk digital evidence that may prove decisive in the proceedings.
