Digital forensic analysis of WhatsApp messages

WhatsApp messages are increasingly used as digital evidence in legal proceedings. When a conversation is relevant to prove or challenge certain facts, its analysis should not be limited solely to what appears on the phone screen, but may require examination of the device and the data stored by the application in order to assess its origin, authenticity and integrity.

A paper printout, screenshot or exported conversation may be useful for displaying the messages, but they do not, on their own, contain all the information that may be available on the device and within the databases and files associated with WhatsApp. A forensic examination may require the extraction and preservation of this data in order to analyse the messages, participants, dates, attachments, identifiers and other available records together.

In this type of examination, it is important to maintain a cautious conclusion. A forensic analysis should not present the authenticity of a conversation as an absolute certainty, but rather assess the available evidence and determine whether or not technical indications of manipulation are observed.

What do we analyse in a WhatsApp forensic examination?

  • Preservation and acquisition of evidence: identification and preservation of the device and the data under examination, documenting the actions performed in order to maintain their traceability and integrity throughout the forensic process.
  • Forensic extraction of the WhatsApp database: acquisition, when permitted by the characteristics of the device and the available level of access, of the databases and files associated with WhatsApp in order to preserve and analyse the information stored by the application beyond its simple visual representation on screen.
  • Analysis of the database and conversations: examination of the available records in order to relate messages to their participants, dates, identifiers, groups and other associated information, checking their correspondence and consistency within the conversation under analysis.

  • Attachments and multimedia content: examination of photographs, documents, audio files, voice messages and videos associated with the messages, comparing their relationship with the conversations and with the records available on the device.
  • Deleted messages and residual data: search for deleted messages, records or files when the characteristics of the device, system and preserved data technically allow their recovery or identification.
  • Counter-examination of WhatsApp conversations: review of the device, conversations and reports submitted by the opposing party in order to determine whether the conclusions reached are supported by the evidence examined and by the methodology applied.

Spanish Law 12/1986 of 1 April recognises the full professional powers and responsibilities of technical engineers within their respective fields of specialisation and expressly includes the preparation of expert assessments, studies and reports .
