Its primary goal is to detect methodological flaws, significant omissions, analytical biases, or unsupported conclusions that may compromise the technical and legal validity of the original report.
Counter-forensic analysis goes beyond merely pointing out errors — it critically assesses the coherence, logic, and reliability of the entire forensic process, from the chain of custody to the interpretation of the digital evidence. It also examines whether the tools used were appropriate, whether the conclusions are adequately supported, and whether the expert has acted with the impartiality required in these proceedings.
To submit a counter-expert report within a legal case, the party’s legal counsel must formally request it from the court, through an official motion for expert challenge. Timing is critical: there is a limited procedural window for filing objections or submitting additional reports, and any delay may imply tacit acceptance of the original findings.
